Mochila Wayuu LLC operates mochilawayuu.com (the “Site”) and sells handcrafted Wayuu bags and related accessories (the “Products”). By accessing the Site or placing an order, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site. “You,” “your,” “customer,” or “user” means anyone accessing the Site or purchasing Products.
You must be the age of majority in your jurisdiction to order. You agree not to use the Site or Products for unlawful purposes or to violate applicable laws. You must not introduce malware, interfere with the Site, or attempt to access non-public areas.
We may refuse, limit, or cancel service or orders at any time for any reason, including suspected fraud, bulk purchasing, or inventory error. We use third-party payment processors; payment card data is handled by those processors under their terms and security programs. We use industry-standard protections, but no method is 100% secure. See our Privacy Policy (incorporated by reference) for how we handle personal data and electronic communications.
We strive for accurate descriptions, colors, pricing, and availability. Each Mochila Wayuu is handmade—natural variations in size, pattern, tension, tassels, and color are expected and not defects. Materials are artisan-selected and may vary by piece (e.g., acrylic yarns or blends). We do not guarantee fiber composition unless expressly stated on the product page. Information and photos are provided for general guidance and may differ slightly from the item you receive. We may correct site content errors without notice.
We may change prices, descriptions, or availability without notice and may modify or discontinue any part of the Service without liability.
Handmade nature. Our Products are handmade by independent Wayuu artisans—primarily in La Guajira, Colombia, with select pieces from other regions.
Availability. Quantities are limited and not guaranteed. We may refuse, limit, or cancel any order (including multiple orders using the same account, payment method, or shipping address).
Your order is an offer. Submitting an order is an offer to buy. We accept only when we send an order-confirmation email. If we cannot accept, we’ll cancel and promptly refund any amount charged to your original payment method.
Errors. We may correct errors or inaccuracies (including price, availability, or descriptions). If an error affects your order, we may cancel it and issue a prompt refund if you were charged.
Provide current, complete, and accurate purchase/account information. Accepted payment methods appear at checkout (e.g., major cards, PayPal, Apple Pay, Google Pay, Shop Pay). Your card may be charged at purchase to reserve inventory. If a payment method fails, we may cancel or hold the order until resolved. You are responsible for all applicable sales/use taxes, import duties, VAT/GST, and similar fees. Any installment/financing options shown are offered by third parties and subject to their terms.
Processing time. Typically 1–2 business days after payment clears.
U.S. shipping. Tracked delivery generally 3–5 business days after processing.
International shipping. Tracked delivery generally 7–14 business days; customs can add time. Recipient is the importer of record and responsible for duties/taxes.
Risk of loss. Title and risk of loss transfer upon the carrier’s delivery scan to your shipping address. After delivery, loss/theft claims must be made with the carrier; we’ll assist where possible.
Wrong address / refused packages. If returned due to an incorrect address provided by you or refusal, we can reship (additional postage) or refund minus original shipping and a reasonable restocking fee if the item returns in sellable condition.
Marked “Delivered.” If a parcel shows delivered but you cannot locate it, notify us within 3 calendar days. We’ll help start a carrier trace/claim, but we cannot guarantee replacement or refund for packages confirmed as delivered.
Return window. Request within 30 days of delivery.
Condition. Unused, unwashed, odor-free, original condition with all tags/packaging. Handmade variation (size, tension, tassel length, dye tone) is not a defect.
Authorization (RMA). Email support@mochilawayuu.com with order # and reason to receive a Return Authorization (RMA) and return address. Returns without an RMA may be refused.
Costs & fees. Customer pays return shipping (trackable service). 15% restocking fee applies to returns (waived for like-for-like exchanges or store credit). Original shipping/duties/taxes are non-refundable.
Refund timing. Refunds to the original payment method within 5–7 business days after inspection (your bank may take an additional 3–5 business days to post).
Exchanges. Tell us the item you want when requesting the RMA; we can hold it 48 hours. We ship your exchange after the original is received and approved. If unavailable, we’ll offer store credit or a refund (less applicable fees).
Damaged or defective on arrival. Contact us within 7 days with photos (item + packaging). U.S.: prepaid label for confirmed defects/damage; we replace or refund. International: we’ll work on a solution; prepaid labels may not be available in all countries.
International returns. Mark the parcel “Return—no commercial value.” Any duties/brokerage charged back to us will be deducted from the refund.
Not eligible. Custom/commissioned items, wholesale purchases, gift cards, used/washed items, items with removed tags, or items damaged by improper care (e.g., machine washing/drying, bleach/solvents/heat, prolonged sun, overloading, alterations).
Care reminder (eligibility impact). Machine washing/drying, bleach, solvents, heat, and prolonged sun can damage a hand-woven mochila and void return eligibility for defects.
The Site’s content (text, graphics, logos, photos, product images) is owned by Mochila Wayuu LLC or its licensors/artisans and protected by IP laws. You may not copy, distribute, modify, or exploit Site content without our prior written consent.
We may link to or surface third-party tools/sites we don’t control. Use is at your own risk and subject to those third parties’ terms and policies.
If you submit reviews, photos, or other content (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, adapt, and distribute those Submissions in any media for marketing and operational purposes. You represent you own or control the rights and that your Submissions do not violate others’ rights or laws. We may remove Submissions at our discretion.
You agree not to use the Site to: (a) violate laws or IP rights; (b) harass, abuse, or discriminate; (c) upload malware; (d) scrape or harvest personal data; (e) spam/phish; or (f) circumvent security controls.
Products and the Site are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Handcrafted irregularities are normal and not defects. Your statutory rights (e.g., in the EEA/UK) may apply where they cannot be excluded.
To the fullest extent permitted by law, Mochila Wayuu LLC and its owners, employees, and agents are not liable for any indirect, incidental, punitive, or consequential damages. Our total liability for any claim will not exceed the amount you paid us for the affected Products in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations; those limits apply only to the extent permitted.
You agree to defend, indemnify, and hold Mochila Wayuu LLC harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of third-party rights.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
We may suspend or terminate access to the Site for violations of these Terms. You remain responsible for amounts due before termination. Sections that, by their nature, should survive (e.g., IP, disclaimers, limits of liability, indemnity, arbitration) will survive.
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Subject to Section 20, the exclusive venue is the state or federal courts in Cleveland County, Oklahoma.
Informal resolution. Before filing a claim, the parties will try to resolve disputes in good faith for 30 days after written notice.
Binding arbitration. Except for small-claims court matters and claims seeking temporary or preliminary injunctive relief for IP or misuse of the Site, any unresolved dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Rules if applicable), held in Oklahoma, in English, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes will be resolved only on an individual basis; no class, consolidated, or representative actions/arbitrations.
Opt-out. You may opt out of arbitration by emailing support@mochilawayuu.com within 30 days of your first purchase after the Effective Date, stating your name, order number, and a clear request to opt out.
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, war, labor disputes, carrier or customs delays, or governmental actions).
Promotions/coupons cannot be combined unless stated, are not redeemable for cash, may exclude certain items, and may be modified or ended without notice. Gift cards are final sale and not refundable except where required by law.
Purchases are for personal use or approved wholesale only. No unauthorized resale. You agree to comply with U.S. export controls and OFAC sanctions; you will not purchase if you are located in, or are a resident of, a sanctioned jurisdiction or on a restricted list.
Our Privacy Policy (at /privacy-terms/) is incorporated by reference. By using the Site, you consent to receive transactional emails (order confirmations, shipping updates). Marketing emails/texts are optional and require your consent; you can opt out at any time (instructions in each message). Message/data rates may apply for SMS.
If you believe content on the Site infringes your copyright, send a notice to support@mochilawayuu.com including: (a) your contact info; (b) identification of the copyrighted work; (c) the URL of the allegedly infringing material; (d) a statement of good-faith belief; (e) a statement that your notice is accurate and, under penalty of perjury, you are the owner/authorized agent; and (f) your physical or electronic signature.
We aim to make the Site accessible and continuously improve it. If you encounter an accessibility barrier, email support@mochilawayuu.com with “Accessibility” in the subject line and describe the issue and page URL.
Headings are for convenience only. You may not assign your rights or obligations under these Terms without our prior written consent. Our failure to enforce any provision is not a waiver of future enforcement.
These Terms (plus any additional terms we provide at purchase and our Privacy Policy) are the entire agreement between you and us regarding the Site and Products and supersede all prior or contemporaneous communications.

Mochila Wayuu LLC (“Mochila Wayuu,” “we,” “us,” or “our”) explains below how we collect, use, disclose, and safeguard personal information when you visit mochilawayuu.com (the “Site”) or purchase our products (the “Services”). By using the Services, you agree to this Policy. If you do not agree, please do not use the Services.

We collect the following categories of personal information for the purposes listed below and retain records as long as needed for those purposes (generally up to 7 years for order/financial records, shorter for analytics/cookies per configuration):
Identifiers (name, email, phone, postal address, IP).
Commercial information (products viewed/purchased, returns).
Internet or network activity (pages viewed, device/browser type, IP, timestamps, referral URLs).
Approximate geolocation (derived from IP).
Inferences (general interests or preferences from on-site activity).
Purposes: operate the Site, process/ship orders, customer support, fraud/security, analytics/performance, and—where permitted—marketing/retargeting.
Sale/Sharing: We do not sell personal information for money. We may “share” personal information for cross-context behavioral advertising (retargeting/ads). See Your Privacy Choices to opt out.
Sensitive information: We do not seek to collect sensitive personal information.

Payment providers, shipping carriers, analytics, anti-fraud, and platforms needed to operate the Site (e.g., WordPress/WooCommerce/Elementor, hosting/CDN).
Transactions: process, fulfill, and deliver orders; handle returns and support.
Communications: send order confirmations, shipping updates, and service messages; where permitted, send marketing (you can unsubscribe anytime).
Security/Fraud: prevent abuse, detect suspicious activity, and protect the Services.
Operations/Improvement: run, maintain, and enhance Site functions and user experience.
Legal/Compliance: meet tax/accounting and other legal obligations; enforce our Terms.
We do not sell personal information for money. We may disclose the categories listed above to:
Service providers/processors: hosting/CDN/email, website platform (WordPress/WooCommerce/Elementor), payment processors (e.g., card processors, PayPal, Shop Pay if enabled), shipping carriers, email & analytics providers.
Advertising/analytics partners (where permitted): to measure performance and, if you allow, to personalize/retarget ads (this may be “sharing” under CPRA).
Legal/safety: to comply with law, respond to valid requests, or protect rights/safety.
Business transfers: as part of a merger, acquisition, or asset sale under equivalent protections.
We require service providers to use personal information only to perform services for us and to protect it appropriately.
If you accept advertising/analytics cookies, we may use pixels/SDKs (e.g., Google Analytics/Ads, Meta, Pinterest, etc.) to measure performance and show relevant ads. Under CPRA, some of this may be considered “sharing” for cross-context behavioral advertising.
Opt out of “sharing” / targeted ads: Visit /privacy-choices and adjust our cookie banner settings; use browser settings and platform ad preferences. We honor Global Privacy Control (GPC) signals where required.
Email marketing: unsubscribe using the link in any marketing email or contact us.
Blocking cookies may affect some features (e.g., saved preferences).
Payments are processed by third parties. We receive limited information necessary to confirm your order (e.g., last 4 digits, status). We do not store full card numbers.
We operate in the United States and ship worldwide; your information may be processed in the U.S. or other countries that may have different data-protection laws. We use appropriate safeguards where required (e.g., standard contractual clauses).
Depending on where you live, you may have rights to:

Authorized agents (CA): must provide proof of authorization; we may still require user verification.
Non-discrimination: We will not discriminate against you for exercising privacy rights allowed by law.
Legal bases (EU/UK GDPR): contract (fulfill orders), legitimate interests (security, improvements, limited direct marketing), consent (where required—e.g., certain cookies/ads), and legal obligations (tax/accounting).
We retain personal information only as long as needed for the purposes above and to comply with legal/tax requirements. Typical periods:
Order/transaction records: up to 7 years (tax/accounting).
Customer support emails: up to 3 years (or less if you request deletion and law allows).
Analytics/advertising data: per tool settings and your preferences (often 3–26 months).
When no longer needed, we delete or de-identify information.
We use SSL, secure hosting, access controls, and other industry-standard safeguards. No method of transmission or storage is 100% secure; use the Services at your own risk.

The Site may link to third-party sites/services we don’t control. Their privacy policies govern those sites—review them before sharing data.
Our Services are not directed to children under 13, and we do not knowingly collect their data. If a child provides personal information, contact us and we will delete it. In the EEA/UK, we do not knowingly process personal data of children under 16 without appropriate consent.
There is no industry consensus on DNT signals, so we do not respond to DNT. Use /privacy-choices, our banner, and browser settings to manage tracking.
California (CPRA): rights to know, correct, delete, portability, and to opt out of “sharing” (targeted ads). We do not sell personal information for money. Submit requests to privacy@mochilawayuu.com. “Shine the Light” requests: same address. We will honor GPC where required.
Colorado/Connecticut/Virginia: rights to access, delete, correct, portability, and opt out of targeted advertising. Appeals: reply to our decision email with “Appeal.”
Utah: rights include access, delete, portability, and opt out of targeted advertising.
Nevada: we do not sell personal information as defined by Nevada law; opt-out requests may be sent to support@mochilawayuu.com.
We may update this Policy from time to time. The “Last Updated” date shows the latest revision. Material changes will be posted here. Your continued use of the Services after changes means you accept the updated Policy.
